Welcome to Nutricoach Tracker ("Nutricoach", "we", "us", or "our"). These Terms and Conditions (“Terms”) govern your access to and use of the Nutricoach Client mobile and web application ("App", "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

1. Eligibility

You must be at least 18 years old to use this App. By using the Service, you represent that you are at least 18 and legally capable of entering into a binding agreement.

2. Not Medical Advice

Nutricoach is not a medical provider. The App provides general educational and habit-based health tools, including calorie tracking, meal logging, behavior change tips, and fitness suggestions.

Nothing on the App constitutes or is intended to substitute for professional medical advice, diagnosis, or treatment. Always consult your physician or a qualified health provider before beginning any weight loss, diet, or exercise program.

3. HIPAA Disclaimer

Nutricoach is not a covered entity under the Health Insurance Portability and Accountability Act (HIPAA), and your use of the App does not create a patient-provider relationship. Any personal health information you provide is handled according to our Privacy Policy but is not protected under HIPAA.

4. User Responsibilities

  • Use the Service for personal, non-commercial purposes.
  • Provide accurate, current, and complete information.
  • Maintain the security of your account credentials.
  • Not interfere with or misuse the App or related systems.
  • Not use the Service to upload any harmful, offensive, or illegal content.

5. Subscription & Billing

  • Nutricoach offers both free and paid subscriptions.
  • Paid plans are billed through Apple App Store, Google Play Store, or Stripe.
  • Subscriptions auto-renew unless cancelled at least 24 hours before the end of the billing cycle.
  • You can manage or cancel your subscription via your device’s settings.
  • Except where required by law, all payments are non-refundable.

6. Cancellation and Account Termination

You may cancel your subscription at any time. Deleting the app does not cancel your subscription. Nutricoach reserves the right to suspend or terminate accounts that violate these Terms or harm other users or the platform.

7. Data & Privacy

Your privacy is important to us. We collect, use, and store data in accordance with our Privacy Policy. By using Nutricoach, you consent to this data use.

8. Intellectual Property

All intellectual property rights in the App and its content (except user-submitted entries) belong to Nutricoach or its licensors. You may not copy, modify, distribute, or reverse-engineer any portion of the App.

9. User-Generated Content

Some features in Nutricoach may let you enter or share content — like journal entries, notes, feedback, or posts in community spaces. Here's how we handle that:

  • You own your content. Anything you add is still yours.
  • We need permission to use it. By sharing content in the app, you give us permission to use, display, and share it to operate and improve the Service. This license is worldwide, non-exclusive, and royalty-free.
  • You’re responsible for what you post. Please don’t upload anything offensive, illegal, harmful, or misleading. We may remove content that violates these guidelines or our community standards.

We want Nutricoach to be a supportive, respectful space — please help us keep it that way.

10. Limitation of Liability

To the fullest extent permitted by U.S. law, Nutricoach and its affiliates will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits or data, resulting from:

  • Use of or inability to use the Service
  • Any unauthorized access to your account
  • Any inaccuracies in data or guidance provided by the App

11. Indemnification

You agree to defend, indemnify, and hold harmless Nutricoach and its officers, employees, and agents from and against any claims, damages, liabilities, and expenses arising out of your use of the Service or violation of these Terms.

12. Modifications

We may update these Terms at any time. If changes are significant, we will notify you through the App or email. Continued use of the Service after updates means you accept the revised Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules.

Arbitration Clause: Any disputes arising from these Terms or the use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive the right to participate in a class action lawsuit.
